Who pays recruitment agency fees in Poland?
Short answer: Polish rules restrict employment agencies from charging jobseekers for job placement, so in practice the commercial relationship is with the employer; limited exceptions exist for some costs of referral abroad, and the fee model should always be agreed in writing.
The rule in outline
Official Polish guidance for jobseekers states that agencies may not charge jobseekers for job placement, and that doing so is an infringement. Limited exceptions are described for specific costs connected with referral abroad (for example travel, visa, medical examinations or document translation). The exact scope should be checked against the current legislation or with the Polish labour authorities.
Why employers should care
- Reputational and legal risk. An agency that charges workers for a placement can expose the hiring employer to problems, particularly in countries that apply strict anti-exploitation rules.
- Clarity of cost. Employers should expect to agree fees with the agency directly and should ask whether workers are asked to pay anything.
- Due diligence. Ask for the agency’s KRAZ registration and written confirmation of its fee policy.
What to put in the agency agreement
- What is charged, when it is due and what triggers it.
- What happens if a worker leaves early or does not start.
- Which party pays which costs of travel, accommodation and onboarding.
- Confirmation that no placement fees are charged to workers.
